Authorization as Forwarding Agent
By tendering a shipment to Icon Logistics Services LLC ("Icon Logistics," "we," "us," or
"our"), the customer ("Customer," "you," or "your") hereby authorizes Icon Logistics
Services LLC and its employees to:
1.1 Act as the Customer's forwarding agent for export control and
customs purposes.
1.2 Prepare, sign, declare, or swear to any Shipper's Export
Declaration (SED) or other export documentation required by applicable law or regulation
in connection with the exportation of any commodity shipped by the Customer.
1.3 Ensure compliance with the requirements set forth under 19 CFR ยง
192 of the U.S. Customs and Border Protection regulations.
1.4 Use Icon Logistics' U.S. address for purposes of the dock receipt
and Automated Export System (AES) filing, where applicable.
2.
Payment Terms
2.1 Shipments are accepted on the condition that full payment is
received no later than thirty (30) days following the vessel's arrival at the port of
destination.
2.2 If payment remains outstanding beyond this 30-day period, the
destination agent reserves the right to auction the unit to recover outstanding amounts
owed.
2.3 The Customer remains responsible for any balance owed in the event
that auction proceeds are insufficient to cover outstanding freight, fees, and related
costs, where permitted by applicable law.
3.
Liability and Insurance
3.1 Icon Logistics is not responsible for delays in the delivery of
cargo resulting from carrier schedules, vessel overbooking, or other circumstances
outside of its direct control.
3.2 Icon Logistics shall not be held liable for lost cargo.
3.3 Icon Logistics strongly recommends that the Customer obtain
additional cargo insurance for all shipments, whether transported by air or ocean, to
protect against loss, damage, or delay.
By tendering cargo to Icon Logistics Services LLC, the Customer acknowledges and agrees to the
terms set forth above.
